These Terms and Conditions apply to all legal relations between Shellfire GmbH (hereafter referred to as Shellfire) and its customers. They apply exclusively and replace all previous Terms and Conditions. Other Terms and Conditions are expressly revoked.
Shellfire offers online VPN services as well as voice and text communication and a matching hardware product. The relevant instructions on the website and on other media sources are not offers of contracts but invitations for contract offers to be made ("invitatio ad offerendum"). In order to use Shellfire services, the user must be at least 16 years of age. A contract is only concluded when confirmation is received from Shellfire.
The services and hardware are only intended for consumers. Shellfire guarantees a 99% availability rate during the contract. The hardware remains the property of Shellfire until it is paid for.
Customers must always be aware that even the best encryption can be cracked and a VPN is useless when the customer's PC or other devices are infected with viruses or malware. Also, the customer must be aware that voice and text communications can be intercepted. Therefore, customers should not to transmit sensitive information without additional means of encryption. The customer must always update the software on their end device, especially the operating system and the anti-virus and security software.
Shellfire assumes absolutely no liability for damages resulting from its services as far as legally possible. Damages to body and health or damages due to intent or gross negligence are excluded from this disclaimer.
In particular, Shellfire is not liable for any damage resulting from malware on the customer's device or if communication is intercepted by Government activities or zero-day exploits.
The law of the Federal Republic of Germany shall apply. UN purchasing law is excluded. The courts at Shellfire GmbH's headquarters have local jurisdiction, as long as this choice of jurisdiction is legally valid.
